Plea By Mail
Traffic and Parking Violations Only – No Photo Enforcement Violations, et al.
The Nassau County Traffic and Parking Violations Agency (TPVA) offers a Plea Bargain by Mail program. The program is being offered to provide the ability to dispose of open traffic and parking violations without having to appear at the TPVA.
Eligibility
Tickets where a disposition has not been entered into the Court’s record. Which means, you have not been convicted after a trial or previously entered into a disposition to plead guilty to a violation, including pleading guilty to a reduced charge.
All tickets from one stop (all tickets issued out of one incident) must be addressed. You cannot dispose of one or 2 tickets and not dispose of the remaining tickets from the same incident. The following violations are ineligible for the Plea Bargain by Mail Program
- A Second or Subsequent charge of any offense within an 18-month period,
- Any Speeding Offense,
- Plates not Issued by the Commissioner or Plates of More than One State,
- Improper Plates,
- Leaving Scene of Incident,
- Failure of Emergency Vehicle Operator to Use Reasonable Care,
- Passing a stopped school Bus,
- Driving under or Around Railroad Crossing Gates,
- Failing to Yield Right of Way to Emergency Vehicle
Program Steps
An application is automatically sent for non-appearance violations (as noted above) when a plea of not guilty is received. An application is submitted by mail to TPVA. The application should list the ticket(s) that you would like to receive an offer.
A TPVA Traffic Prosecutor will review the application. The review may include your NYS DMV driving abstract as well as TPVA court records. In addition, the review will take into consideration the severity of the violations. The Traffic Prosecutor will respond back to you, by mail, with a proposed offer or a rejection notification.
You will have the opportunity to review the offer. If you do not accept the offer, return the form with the appropriate box selected. There is no adverse impact to you for rejecting the proposed offer. Additional fines, penalties and fees will not be assessed during this review period. You will be scheduled and notified of a conference or trial date.
If you do accept the offer, please sign and complete the form with the required payment. The offer is made as including all of the tickets issued from the same incident. You cannot select which tickets(s) you would like reduced and ignore the other (ticket(s) in the offer. Please enclose a self-addressed stamped envelope, along with your payment, if you would like to receive a receipt.
The Prosecutor’s offer and your acceptance of said offer is subject to the Judicial Hearing Officer’s approval. Thus, the offer is then submitted and considered by a Judicial Hearing Officer. If the offer is accepted, the application and offer will be processed by the Court. If you provided a self-addressed stamped envelope, you will receive a receipt for your payment. If the offer is rejected, you will be notified by mail and your payment will be returned. Again, no adverse effect, no fines, penalties or fees will not be assessed during this review period. You will receive notice of a scheduled conference date or a trial date.
