Applicable Fees
The residents of Nassau County should not have to shoulder the expenses for motorists who fail to comply with the various parking and traffic regulations and laws. With this principle guiding the agency, the following fees shall be applied.
PUBLIC SAFETY FEE
Effective January 2, 2017, A $55 fee is assessed on traffic and camera violations issued on or after January 2, 2017. This fee is for the purpose of promoting and protecting the safety and well-being of the residents and visitors to the County, including but not limited to traffic safety, policing security and anti-terrorism activities, and by deterring illegal and reckless driving.
DRIVER RESPONSIBILITY FEE
A $45 Driver Responsibility Fee (DRF) is assessed on any ticket or Notice of Liability (NOL) for any disposition other than Not Guilty.
Equipment violations as specified in NYS VTL 376-A(4) dismissed after January `1, 2016 and repaired within 24 hours are eligible to be dismissed as Not Guilty upon proof of repair.
INITIAL DEFERRED PAYMENT FEE – PER TICKET
A $15 fee to encourage immediate payment and to defray the cost of delayed payment.
SUBSEQUENT DEFERRED PAYMENT FEE – PER DEFERRAL – Per Ticket
A $10 fee to encourage the payment within the deferred payment time and to defray the cost of granting and recording additional time to pay.
SCOFFLAW/DEFAULT JUDGMENT ADMINISTRATIVE PROCESSING FEE
A $15 administrative fee to defray the costs of processing a scofflaw/default judgment request. A scofflaw request includes notifying NYSDMV. A Scofflaw/Default Judgment request requires sending a certified or registered mailing, return receipt requested to each scofflaw/default judgment candidate.
DEFAULT CONVICTION ADMINISTRATIVE PROCESSING FEE
A $75 administrative fee to defray the costs of processing a default conviction. A default conviction is filed against the defendant when he/she fails to appear for a scheduled trial or hearing. The scheduled trial or hearing is a specific time set aside for the defendant to provide their testimony and/or evidence, why they believe they are not guilty of the alleged violation. Nassau County brings the issuing officer to court to explain the circumstances that caused the issuance of the summons. When the defendant fails to appear as scheduled, a default conviction is recorded and transmitted to DMV.
MOTION TO VACATE DISPOSITION FEE – WRITTEN APPLICATION FEE
A $125 administrative fee to defray the costs of processing a written application of motion to vacate a disposition. The processing of a written application involves a Prosecutor review and written response, a Judicial Hearing review, clerical support and in some cases filing various documents with NYS DMV to vacate the previously disposed violation on the operators driving record.
MOTION TO VACATE DISPOSITION FEE – ORAL APPLICATION FEE
A $50 administrative fee to defray the costs of processing an oral application of motion to vacate a disposition. The process includes reviewing why the defendant missed their specific trial or hearing date, and whether or not a defendant has a meritorious defense. An oral application involves a Prosecutor review, a Judicial Hearing review, clerical support and in some cases filing various documents with NYS DMV to vacate the previously disposed violation on the operators driving record.
TRANSFER OF NOTICE OF LIABILITY FEE
A $30 administrative fee is assessed to offset the cost of reassigning the Notice of Liability. The Red Light Camera and the Speed Camera legislation contains language that is specific to a lessor who must provide information as to who rented, leased, or contracted the use of the vehicle at time of violation.
CREDIT CARD CHARGEBACK PROCESSING FEE
A $50 administrative fee (which is assessed by a vendor) when a previously posted credit card transaction is reversed. In addition, TPVA may have to vacate the dispositioned charges.
BOUNCED CHECK FEE
A $25 fee to cover the processing of a bounced check.
CONVENIENCE FEE
For payments made by credit cards, a credit card convenience fee will be assessed.
SUSPENSION LIFT FEE
A $70 per ticket charge imposed by NYS DMV up to a maximum of $400 paid on a given day.
