PRE-TRIAL SERVICES
In April 2019, New York State passed legislation which eliminated bail for most misdemeanors and non-violent felonies and instead mandated the court to impose the least restrictive conditions to make sure a defendant charged with a crime returns to court to face the charges.

Pursuant to the change in the Law, Nassau County has expanded our Pre-Trial Services to give the Court the best options to maximize compliance with Court Release Conditions.
NON-MONETARY CONDITIONS
What are non-monetary conditions?
After an arraignment on criminal charges, the Court will decide whether setting bail is appropriate under the law and if monetary bail is required to make sure that the person who is charged returns to Court for all future proceedings.
The Court in their discretion can set Non-Monetary Conditions. These conditions are intended to make sure that the defendant returns to Court. Pre-Trial Services is one option available to the Court.
TYPES OF CONDITIONS:
- Surrender Passport or license
- Curfew
- Surrender weapons
- Counseling/treatment
- Attend school/job
- Orders of protection
PTSA - ELECTRONIC MONITORING (EM)
TYPES OF EM
- GPS: (Global Positioning Satellite) is a secured ankle bracelet that allows the Probation Department to track the defendant’s whereabouts 24 hours a day in real time. GPS monitoring can include set parameters and restrictions if, in addition to helping to ensure the person’s return to court, it is also intended to keep the defendant in or away from a designated location.
- SCRAM: SCRAM (Secure Continuous Remote Alcohol Monitoring) is a secured ankle bracelet that allows the Probation Department to track a defendant’s location and detect alcohol usage 24 hours a day.
COMPLAINCE WITH EM REQUIRES:
- Immediate installation at Probation Offices located at 400 County Seat Drive, Mineola
- Nightly charging of the bracelet
- Compliance with ordered restrictions
If a defendant fails to comply with the non-monetary conditions of release, the Court may set more restrictive conditions, set bail, or possibly remand the defendant to the Nassau County Correctional Center.
If a defendant fails to return to Court, a warrant can be issued by the Court. Failure to appear for any future hearings may also result in additional conditions of release, forfeiture of any bail posted, or Incarceration.
