Mobile Food Preparation Vehicles (Food Trucks)
Since 2008 there has been a steady increase in specialty and gourmet food trucks. With the increase in food trucks there has also been an increase in incidents involving food trucks that have lead to injuries and death. In July 0f 2008 an incident occurred in Philadelphia which took the life of 2 people and seriously injured 11 others.
The following are requirements of the Fire Code of NYS and the reference standards NFPA 58 & 96, which have been adopted by the Nassau County Fire Prevention Ordinance which will provide a way to continue to operate food trucks in a safe manner along with existing DOT regulations.
- NFPA 96 B.9.1.5 Complete drawings of the system installation, including the hood(s), exhaust duct(s), and appliances, along with interface of the fire-extinguishing system detectors, piping, nozzles, fuel and electric power shutoff devices, agent storage container(s), and manual actuation devices as well as the gas detector, CO detector and extinguisher shall be submitted to the authority having jurisdiction.
- NCFPO 14.18.2.2 Request for final approval shall be submitted in accordance with Article XXVII of the Fire Prevention Ordinance.
- FC-NYS § 319.3 Cooking equipment that produces grease-laden vapors shall be provided with an exhaust hood in accordance with Section 607.
- FC-NYS § 319.4 Cooking equipment shall be protected by an automatic fire extinguishing system in accordance with Section 904.12.
- FC-NYS § 904.12.2 The actuation of the fire extinguishing system shall automatically shut down the fuel or electrical power supply to the cooking equipment.
- NFPA 96 4.1.9 Cooking equipment used in mobile concessions such as trucks, buses or trailers shall comply with this standard as well as Annex B of said section.
- FC-NYS § 319.5 Cooking appliances shall be secured in place and connected to fuel-supply piping with an appliance connector complying with ANSI Z21.69/CSA6.16

- FC-NYS § 319.8.1 - 8 Any system where LP-gas provides fuel for the cooking appliances shall be allowed a maximum aggregate of 200lbs of LP, the LP containers shall be securely mounted and piping shall be protected from tampering and damage, all LP tanks shall be compliant with NFPA58 and all vehicles using LP-gas shall have a listed LP gas alarm in the vicinity of the LP-gas system components.
- NCFPO 6.8.1 No person, firm or corporation shall use or cause to be used any motor vehicle for the transportation of liquefied petroleum gas, unless after complying with this Ordinance, a permit to operate any such vehicle has first been secured from the Fire Marshal. No permit shall be required under this section for any motor vehicle that is used for the transportation of Liquefied Petroleum Gas not operated or registered by an authorized dealer, in containers not larger than ten (10) gallons water capacity each (approximately thirty-four (34) pounds propane capacity) with aggregate, water capacity of twenty-five (25) gallons, (approximately eighty seven
(87) pounds propane capacity) or when used in permanently installed containers on the vehicle as motor fuel. (Fire Marshal’s Permits are required for any motor vehicle that carries an LPG cylinder with more than 34-pound capacity or a total vehicle capacity over 87 pounds.)
- FC-NYS § 906.4 Fire extinguishers provided for the protection of cooking equipment shall be of an approved type compatible with the automatic fire-extinguishing system agent. Cooking equipment involving animal oils and fats shall be protected by a Class K-rated portable fire extinguisher.
- FC-NYS § 319.6 Cooking oil storage containers within mobile food preparation vehicles shall have a maximum aggregate volume of 120 gallons and shall be stored in such a way as to not be toppled or damaged during transport.
- NFPA 96 B.12.1 If the heat source is nonelectric and open flames are used, at least one listed carbon monoxide detector shall be installed.
- NYS DOT § 393.95 the vehicle must be equipped with a single fire extinguisher with a UL rating of 5 B:C or more; or two fire extinguishers with a UL rating of 4 B:C or more (not located in the cooking area).
- NYS DOT § 393.95 Warning devices for stopped vehicles. All vehicles shall have three bidirectional emergency reflective triangles that conform to the requirements of Federal Motor Vehicle Safety Standard No. 125, §571.125 of this title.
