Petroleum Bulk Storage
Facilities that store petroleum products in tank systems regulated under Article XV of the Nassau County Public Health Ordinance (NCPHO) must register such tanks with the Nassau County Department of Health (NCDOH). This includes:
- Individual tanks of more than 1,100 gallons in capacity storing fuel oil used solely for on-site space or water heating.
- One or more petroleum tank systems (other than on site heating oil) having a combined capacity of more than 1,100 gallons.
- An underground petroleum tank system having a storage capacity that is greater than 110 gallons that is not specifically exempted by the regulations.
- One or more aboveground tank systems having a combined storage capacity total of 250 gallons or more that contain petroleum other than heating oil (i.e., motor oil, lubricants, transmission fluid, hydraulic oil, cutting oil, dielectric oil and diesel fuel).
- Any tank system storing used oil, including oil water separators and associated holding tanks.

Functionality Testing of Underground Storage Tanks (USTs)
UST systems, located at regulated facilities, containing petroleum products including gasoline, diesel, kerosene, waste oil, motor oil, etc. (but excluding onsite heating oil, such as Fuel Oil #2) are required to have a Functionality Test conducted every two years. Functionality Tests involve an evaluation of a tank system’s sensors, automatic tank gauging, leak detection equipment, sumps, and valves amongst other items. Only companies that are certified as Tank Installers in Nassau County are eligible to conduct this type of system evaluation. The report documents below include all the items that NCDOH requires as part of a functionality test. This office strongly recommends utilizing those forms when conducting each functionality test in order to be sure that all required items have been evaluated.
PLEASE NOTE: This Department considers the required annual Automatic Line Leak Detector (ALLD) test to be a part of the functionality test. The ALLD evaluation should be performed at the same time.
All tests must be scheduled with this Department via e-mail and must occur during normal business hours. Upon scheduling, the Department will issue a confirmation number that must be associated with the job as well as documented on the test result report. Facility Owners or Contractors must file the results of the report, along with all applicable fees, to this Department within 30 days of the test.

PBS Facility – General Requirements
Facilities that contain underground storage tanks (USTs) that contain non-heating oil petroleum products must designate Class A/B/C UST Operators as per NYSDEC requirements.

Petroleum Spills must be reported to NYSDEC at 1-800-457-7362 and NCDOH within 2 hours of the spill occurring. Spills that meet the following criteria DO NOT need to be reported:
- It is known to be less than five gallons in total volume
- It is contained and under the control of the spiller
- It has not reached and will not reach the land or waters of the State
- It is cleaned up within two hours after discovery
Small Heating Oil Tank Closure (Heating Oil Tanks less than 1,100 gallons not located at an Article XV Regulated Facility)
If you use fuel oil to heat and/or provide hot water to your home or business, you should consider the following facts:
- Fuel oil contains chemicals that can pollute drinking water resources.
- We know that the movement of groundwater is such that we are currently drinking water that was recharged into the ground many years ago.
- Fuel oil that is leaking now may reach our drinking water wells in future years.
- If your oil tank is 30 years old or older it may be about ready to fail.
